1. COLLECTING YOUR INFORMATION
1.1 When you use the Web Site, you acknowledge and agree that you may have to provide Us the following User-provided and usage-based information:
(a) Your username, password, email address;
(b) Profile information that you provide for your user profile (e.g., first and last name, educational and professional information, interests);
(c) User Content (e.g., comments, feedback, posts, and other materials) that you submit to the Web Site.
1.2 Analytics information:
(a) We may use third-party analytics tools to help us measure traffic and usage trends for the Web Site.
(b) We do not collect other information such as the web pages you visit, add-ons, or other information that occurs outside your use of the Web Site. What limited Web Site-specific information we do collect is done in such a way that it cannot reasonably be used to identify any particular individual user.
1.3 Cookies and other similar technologies
(a) We do use cookies and similar technologies like pixels, web beacons, and local storage to track usage, analytics, social media, and advertisements.
1.4 Log file
(a) When you use our Web Site, our servers may automatically record certain log file information, including date and time of your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how a user interacts with links on the Web Site, domain names, landing pages, pages viewed, and other such information. We may also collect similar information from SMS sent to our users which then help us track which SMS are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Web Site; however, this information cannot reasonably be used to identify any particular individual user unless they are logged into the Web Site.
1.5 Device identifiers and metadata:
(a) When you use a mobile device like a tablet or phone to access our Web Site, we may access, collect, monitor, store on your device, and/or remotely store one or more “device identifiers”. Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device, but not you as an individual.
(b) A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by Us. A device identifier may deliver information to us or to a third party partner about how you browse and use the Web Site and may help us or others provide reports. Some features of the Web Site may not function properly if use or availability of device identifiers is impaired or disabled. This information cannot reasonably be used to identify any particular individual user unless they are logged into the Web Site..
(c) Metadata is usually technical data that is associated with user submitted content. For example, Metadata can describe how, when and by whom a piece of user content was collected and how that content is formatted.
2. USING YOUR INFORMATION
2.1 In addition to other uses of your information described under this Privacy Policy, we may use your information to:
(a) Allow you to access your information once logged in;
(b) Remember your previously entered information;
(c) Maintain a record of contractual terms to which you have consented;
(d) Improve, test and monitor the Web Site;
(e) Develop and test new products and features;
(f) Diagnose and fix technical problems related to the Web Site;
(g) Respond to requests, inquiries, comments, or concerns
(h)Offer customized content;
(i)Improve website usage by identifying and analyzing usage trends;
(j)Notify users about changes or updates to products and Web Site;
(k)Provide special offers, promotions, surveys, company news, newsletters, events; and
(l)Other information about the products and Web Site.
3. SHARING YOUR INFORMATION
3.1 We may share your information (including but not limited to, information from cookies, log files, device identifiers, location data, and usage data) with businesses that are legally part of the same group of companies that MyJoVE is part of, or that become part of that group (“Affiliates”). Affiliates may use this information to help provide, understand, and improve the Web Site (including by providing analytics) and Affiliates’ own Web Site (including by providing you with better and more relevant experiences).
3.2 We do not work with third-party organizations to provide Web Site to you or provide Web Site to you independently (“Service Providers”). Therefore, we do not share, sell, or license your information with third-party Service Providers.
3.3 We will disclose information about you to government or law enforcement officials in compliance with the legal process and service of subpoenas to the fullest extent we are technically able. We reserve the right to disclose information about you to government or law enforcement officials, or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), at the request of governmental authorities or other third parties conducting an investigation, to protect the property and rights of MyJoVE or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, fraudulent, unethical or legally actionable activity.
4. CHANGE OF CONTROL AND INFORMATION
4.1 If we sell or otherwise transfer part or the whole of MyJoVE or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information as described under Section 1.1 above, and any other information collected through the Web Site may be among the items sold or transferred. The buyer or transferee will have to honor the commitments we have made in this Privacy Policy.
5. LEGAL REQUESTS AND YOUR INFORMATION
5.1 We may access, preserve and share your information in response to a legal request if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.
5.2 You understand that we can be legally prohibited from disclosing the existence or non-existence of a legal request for your information.
5.3 If we receive a request from a jurisdiction and we believe that request to be inequitable, not lawful, or not consistent with internationally recognized standards, we may not comply with that request. As a result, you understand and agree that you may lose access to the Web Site in that jurisdiction. You further understand and agree that we will not provide any refund or compensation for any loss to you or any other party under such circumstances.
6. HOW WE STORE YOUR INFORMATION
6.1 Your information collected through the Web Site may be stored and processed in the United States or any other country in which we, our Affiliates or Service Providers maintain facilities.
6.2 By registering for and using the Web Site you consent to the transfer of information to the U.S. or to any other country in which we, our Affiliates or Service Providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.
6.3 We use commercially reasonable safeguards to help keep the information collected through the Web Site secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, we cannot ensure the security of any information you transmit to us or guarantee that information on the Web Site may not be accessed, disclosed, altered, or destroyed.
7. SPECIAL NOTE TO INTERNATIONAL USERS
7.1 The Web Site is intended for and directed to users in the United States. If you are a user accessing the Web Site from another region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the Web Site, which are governed by Massachusetts law, this Privacy Policy, and our Terms of Use, you are transferring your personal information to the United States (or any other country in which we, our Affiliates or Service Providers maintain facilities) and you expressly consent to that transfer and consent to be governed by Massachusetts law for these purposes.
7. CHANGES TO OUR PRIVACY POLICY
8.1 We may modify or update this Privacy Policy from time to time, so please review it periodically. We may provide you additional forms of notice of modifications or updates as appropriate under the circumstances. Your continued use of the Web Site after any modification to this Privacy Policy will constitute your acceptance of such modification.
